The client Han Kang lent more than RMB 3.8 million yuan to Han XX, and agreed that the borrower Han XX would return the principal and interests to Han Kang within a certain date. After the client paid the loan to Han XX, Han XX still did not return the loan after being notified by Han Kang. The plaintiff, Han Kang, commissioned our lawyers Yuan Quan and Guo Na to file a lawsuit to recover the money, demanding that the defendant Han XX shall return the principal amount of the loan and its interests.
The focus of the dispute in this case is whether a loan relationship exists between the plaintiff and the defendant and whether the loan amount claimed by the plaintiff is accurate.
In this case, after the plaintiff Han Kang filed a lawsuit, the parties reached a mediation plan on the repayment cycle and amount, and the Dongcheng District People's Court in Beijing issued a mediation statement on this basis. The defendant Han XX has no objection to the facts about loan and the amount stated by the plaintiff, and they agreed to pay the defaulted loan principal of more than RMB 3.8 million yuan and interests in installments.
After accepting the client's entrustment, our lawyers Yuan Quan and Guo Na screened and sorted out the evidence provided by the client. The initial payment records submitted by the client to the court amounted to more than RMB 2.7 million yuan. Our lawyers asked the client to further supplement the payment records for the remaining parts, and actively promoted the conclusion of a mediation plan with the defendant to help the plaintiff recover the loan and interests.
